diagnosis lead : any seller of property built before 1948, assigned in whole or part for human habitation, and located in an area at risk, must produce a statement of risks of accessibility to lead in paint. This condition will be attached to the sale agreement or contract of sale final.
It will not be more than one year to the day of the promise or contract of sale.
From the entry into force of provisions on the diagnosis technique, if the lead concentration is below the regulatory thresholds, there will be no need to re-establish a diagnosis in a subsequent sale.
The risk areas are determined by prefectural order.
The law of 9 August 2004 relating to public health policy, provides for an amendment to these rules. A decree is awaiting publication. In the absence of
statement attached, the seller can not evade the implied warranty.
The presence of lead mentioned in the statement does not prevent the sale. The parties shall determine, in case of positive diagnosis, which assume charge of the work.
